1. Intellectual Property and Ownership
1.1 Ownership Stays with the Creator
Creative Artistic Works (CAW), L.L.C. recognizes that your work is your own. The Creator (author, illustrator, artist) retains 100% of the copyright, title, and interest in and to all materials provided to CAW. Our services are designed to support you, not to acquire your creative assets.
The creator warrants that all materials presented to CAW are original works belonging to the creator and the materials do not infringe on any third-party Intellectual Property Rights. The Creator further warrants that they have the full right and authority to submit these materials for distribution and/or publication.
The creator further warrants that all disclosures regarding the use of Artificial Intelligence (AI) in the creation of the work are accurate and meet the current disclosure requirements of the targeted publishing venues.
1.2 Limited License for Service Performance
By utilizing CAW’s visibility and administrative services (including Author Showcases, Sales Promotions, and Proxy Submissions), you grant CAW a non-exclusive, limited, and revocable license to:
- Store and Host: Maintain digital copies of your work on our secure servers.
- Publicly Display: Present your materials (such as excerpts, cover art, and bios) on the CAW platform as part of your Author Showcase or Sales Promotion.
- Distribute for Outreach: Deliver your Creator-generated materials to third-party targets (agents and publishers) as specifically directed by you during the query process.
1.3 Usage Restrictions
CAW will not:
- Sell, license, or distribute your work to any third party for profit outside the scope of your requested services.
- Claim any "derivative works" rights (e.g., we do not own the right to turn your book into a screenplay or audio project).
- Alter the content of your manuscript or materials without your express written consent (in accordance with our no-editing-authority policy).
1.4 Termination of License
You may request the removal of your materials from our platform at any time. Upon termination of your services or a written request for removal, CAW will:
- Deactivate and delete your Author Showcase and Sales Promotion pages.
- Cease all proxy submissions of your materials.
- Retain only the minimum administrative records required by law or for internal accounting purposes.
2. Accuracy Guarantee
Creative Artistic Works, L.L.C. (CAW) stands behind the technical precision of our administrative services. We understand the importance of a first impression in the publishing industry.
2.1 The Double-Refund Promise
If CAW commits a Material Administrative Error during the submission of your project, we will refund twice (2x) the charged fee for the affected query (not including onboarding fee) and submit an additional query free of charge.
2.2 What Qualifies as a Material Administrative Error?
A "Material Administrative Error" is strictly defined as a technical failure to follow the data and instructions provided in the Creator's finalized Onboarding Dossier. This includes:
- Incorrect File Attachment: Submitting a manuscript or synopsis file other than the version approved in the Dossier.
- Contact Errors: Submitting to an agent, editor, or agency not specified on the Creator's target list.
- Missing Required Elements: Failing to include a query letter, bio, or other specific component required by the submission guidelines if that component was provided in the Dossier.
- Metadata Mismatches: Entering a title, word count, or genre that contradicts the data provided during Onboarding.
2.3 Exclusions & Limitations
To maintain this high standard, the following are not considered administrative errors:
- Third-Party Technical Failures: Glitches, crashes, or "lost" submissions caused by third-party portals (e.g., Submittable, QueryManager, or publisher websites).
- Guideline Changes: Rejections based on submission guidelines that were updated by the agent/publisher after the Onboarding Dossier was finalized.
- Subjective Outcomes: Lack of response, "form" rejections, or requests for revisions from agents. The guarantee covers process, not results.
- Creator Data Errors: Errors resulting from incorrect information provided by the Creator during the onboarding phase.
2.4 How to Claim
If you believe a material error has occurred, please notify CAW in writing within 7 business days of the submission date. We will review the submission logs and Dossier; if an error is verified, the double-refund will be processed to your original payment method within 5 business days.
3. Third-Party Content
3.1 No Third-Party Warranty
The CAW platform and Onboarding Dossiers may contain links to third-party sites, submission portals, and industry resources. These links are provided for your convenience and information only. CAW does not own or operate these third-party platforms and makes no warranties regarding their functionality, security, or the accuracy of the information contained therein. Accessing third-party resources is done at the Creator's own risk.
3.2 Third Party Contracts
Creative Artistic Works, L.L.C., acts as an infrastructure provider and administrative proxy. Any agreements, contracts, or service arrangements entered into by the Creator with third-party professionals, service providers, or platforms identified through the CAW platform are strictly between the Creator and that third party. CAW is not a party to, nor responsible for the performance, quality, or legal obligations of such third-party contracts.
4. Security & Data Handling Policy
Creative Artistic Works, L.L.C. (CAW) treats your unpublished intellectual property with the highest degree of care. Our security protocol is designed to ensure that your manuscript remains confidential and accessible only to authorized personnel.
4.1 Secure Infrastructure
We utilize Smartsheet and Google Drive for all project management and file storage.
- Encryption: Data is protected using industry-standard encryption at rest and in transit (SSL/TLS).
- Access Control: All CAW accounts are secured with Multi-Factor Authentication (MFA). Access to specific sheets and folders is restricted to the assigned Proxy Submission Specialist and the Creator.
- Privacy Settings: All Creator work environments are set to Private. They are not indexed by search engines and cannot be accessed by the public.
4.2 Chain of Custody
- Ingest: Files are uploaded directly to your private Google Drive folder or attached to your secure Smartsheet project row during the Onboarding Phase.
- Handling: Our specialists access these files only for the purpose of fulfilling the submission request. We do not download manuscripts to personal devices or unencrypted local drives.
- Transmission: When submitting to third-party portals (e.g., QueryManager, Submittable), we use secure browser sessions to ensure your data is transmitted directly to the recipient.
4.3 Data Retention & Deletion
- Active Period: CAW retains your project data for the duration of your active submission contract.
- Archive Period: Upon completion of your final submission, your project files will be archived for 90 days to allow for the verification of any "Material Administrative Errors.
4.4 Confidentiality Agreement (Non-Disclosure)
CAW employees and contractors are bound by a strict Non-Disclosure Agreement (NDA). We will never share, sell, or distribute your manuscript, query letter, or personal contact information to any third party not explicitly listed on your approved Submission Target List.
5. Linking to the Creative Analytic Works Platform
You may link to the Creative Artistic Works (CAW) Platform provided that you do so in a manner that is fair and legal and does not damage or take advantage of our reputation or that of any client or partner.
Restrictions: You are not permitted to suggest any form of association, approval, or endorsement on our part where none exists.
Ownership: You must not establish a link to our platform in any site that does not belong to you. We reserve the right to withdraw linking permission without notice.
6. Content Endorsement
Creative Artistic Works (CAW), L.L.C., hosts a content-neutral platform. Our role is strictly administrative and promotional as defined by our service agreements.
No Endorsement: Although CAW manages the submission and advertising of artistic works, we do not officially endorse the themes, opinions, or specific creative content of any work.
Service-Based Relationship: The presence of a work on our platform or its inclusion in our submission service is a reflection of a business agreement, not an editorial recommendation or a seal of approval.
7. Terms of Use
By using the Creative Artistic Works (CAW) platform, you agree to abide by these standards of conduct. Our goal is to maintain a professional environment that fosters visibility and growth for all creators.
7.1 Eligibility
Services are available strictly to individuals 18 years of age or older. By registering for a service or submitting materials, you represent and warrant that you meet this age requirement.
7.2 Prohibited Content
Although CAW does not have editing authority over your work, we reserve the right to refuse service or remove any hosted content that violates legal or professional standards. Prohibited content includes, but is not limited to:
- Pornography and Erotica: Sexually explicit content or erotica.
- Illegal Material: Content that violates local, state, or federal laws.
- Infringement: Work that violates the intellectual property, trademark, or privacy rights of others.
- Hate Speech & Harassment: Content that promotes violence, incites hatred, or harasses individuals or groups based on race, religion, sexual orientation, or other protected characteristics.
- Malicious Code: Files containing viruses, malware, or any code intended to damage or disrupt the CAW platform.
7.3 User Conduct
To ensure the success and precision of the submission process, the Creator agrees to:
- Accuracy of Information: Provide accurate, truthful, and complete information regarding their identity, their work, and any previous publication history.
- Administrative Cooperation: Respect the CAW administrative process by providing all Dossier materials in the specific formats and timeframes requested during Onboarding.
- Professional Conduct: Use the Creator ’s Professional Network matches and industry contacts for professional inquiry purposes only. Harassment, spamming, or unprofessional conduct toward CAW staff or Network contacts is strictly prohibited and may result in immediate termination of service without a refund.
7.4 Platform Rights & Limitations
- Right to Refuse: At its discretion, CAW reserves the right to refuse service to any individual or project that violates these Terms of Use or the professional spirit of the platform.
- Site Availability: While we strive for 100% uptime for your Creator Showcase, CAW is not liable for temporary service interruptions due to maintenance or third-party hosting issues.
- Administrative Access: You grant CAW staff permission to access your project files for the sole purpose of performing the administrative tasks you have purchased.
7.5 Violation of Terms of Use
Creative Artistic Works (CAW), L.L.C. reserves the right to take whatever action it deems appropriate in response to violation(s) of its Terms of Use. To protect the integrity of our platform and the safety of our partners, CAW may exercise these actions at its sole discretion. Responses to violations may include, but are not limited to:
- Notification: A formal notice of the violation with a request for immediate correction.
- Suspension of Service: Temporary removal of Author Showcases or pausing of administrative/research tasks.
- Termination of Service: Permanent closure of your account and removal of all hosted materials without refund.
- Legal Action: Initiation of legal proceedings or reporting to appropriate authorities in cases of illegal activity or severe breach of contract.
No refunds will be provided for consequences of actions taken in response to violations of terms of use.
8. Dispute Resolution
8.1 Network Professionals (The Creator's Network)
Creative Artistic Works (CAW), L.L.C., facilitates connections between Creators and independent professional (editors, illustrators, marketers, etc.) (Network Professional). CAW does not vet, vouch for, or guarantee the work of any Network Professional. The Creators are solely responsible for vetting the Network Professional, reviewing their portfolio, and determining their suitability for the project. All contracts, payments, and creative decisions are made strictly between the Creator and the Network Professional.
Although Creators should report disputes with the Network Professional, CAW plays no role in resolving those disputes.
8.1.1 Financial Independence
No service fees change hands between the Creator and CAW for Network Professional Services. All financial transactions, contracts, and project management occur directly between the Creator and the Network Professional.
8.1.2 Liability
CAW is not a party to these agreements. Consequently, any disputes regarding quality of work, timelines, or payments are strictly between the Creator and the Network Professional.
8.1.3 Finders Fees
Network Professionals pay CAW a non-refundable finder’s fee upon accepting a project from a referred Creator within 12 months of the initial referral. CAW remains uninvolved in and is not responsible for any subsequent payment disputes between the Creator and the Network Professional.
8.2 Direct Paid Services
Our direct paid services are built on a collaboration between Creative Artistic Works (CAW), L.L.C., and the Creator (author, illustrator, or artist). CAW will work to amicably resolve reasonable disputes with its client Creators.
To maintain the integrity and efficiency of our operations, we adhere to the following refund policy.
8.2.1 Creator Responsibility
Many of our services require active participation from and collaboration with the Creator. Before CAW engages in those services, a CAW representative meets with the Creator to set expectations and answer questions. CAW cannot provide refunds in instances where the Creator fails to provide necessary information, documents, or feedback required to complete the project.
8.2.2 Scope of Service
CAW does not provide refunds for services that have been delivered within their published scope. Once the administrative labor, research, or hosting has been initiated or completed as described, the service is considered rendered.
8.2.3 Partial Refunds
We do not provide partial or prorated refunds for:
- Unused hosting periods.
- Unused editing or service credits.
- Sales promotion extensions or active digital placements.
- Administrative research already in progress.
8.2.4 Administrative Errors & Accountability
At CAW, we take pride in the precision of our work. If a CAW staff member commits an administrative error during the performance of a direct service, we are committed to the following resolution:
- Immediate Correction: Upon identification or notification, we will correct the error immediately at no additional cost to the client, whenever possible (e.g., updating a hosted Showcase or correcting a database entry).
- Refund Eligibility: If an error is irreversible, such as an error occurring during the manual query submission process to an agent or publisher, CAW will refund the collected fees associated with that specific service in accordance with that service's specific refund policy.
9. Privacy Policy
9.1 Information We Collect
To provide our hosting and administrative services, CAW collects the following information:
- Account Information: Name, email address, and contact details.
- Creative Materials: Manuscripts, excerpts, cover art, synopses, and other materials provided by you for your Author Showcase or Query Research.
- Financial Data: Payment information is processed through secure third-party payment processors. CAW does not store your full credit card details on our servers.
9.2 How We Use Your Information
We use your data strictly to fulfill the services you request:
- Visibility: To host your Author Showcase and Sales Promotion pages.
- Outreach: To perform manual query research and proxy submissions to agents and publishers on your behalf.
- The Creator’s Network: To facilitate a "match" by sharing your project overview with potential professional partners at your request.
9.3 Data Sharing & Disclosure
We do not sell your personal information or creative work to third parties. Disclosure of your information occurs only in the following contexts:
- With Your Consent: Sharing your materials with agents, publishers, or network partners as part of your purchased service.
- Service Providers: We may use third-party tools (e.g., website hosting, email platforms) to operate our business, all of whom are required to keep your data confidential.
- Legal Necessity: We may disclose information if required by law to protect our legal rights or comply with a judicial proceeding.
9.4 Security of Creative Intellectual Property
We treat your creative work with the highest level of confidentiality. Your materials are stored on secure servers and are only accessible to CAW staff members as needed to perform administrative tasks. While we implement industry-standard security measures, no digital storage is 100% secure; therefore, we encourage authors to maintain their own primary backups of all work.
9.5. Your Data Rights
You maintain control over your data. At any time, you may:
- Request Access: See the information we have on file for you.
- Request Correction: Update any inaccurate personal or project information.
- Request Deletion: Request the removal of your materials from our platform. Upon request, we will delete your digital assets, though some administrative data may be retained for tax and accounting purposes.
10. Limitation of Liability & Indemnity
10.1 General Limitations
Nothing in these Terms is intended to exclude or limit liability for anything which cannot be excluded by law (such as fraud or gross negligence). Subject to these legal requirements, CAW excludes all conditions, warranties, or representations which may apply to our platform or services, whether express or implied.
10.2 Scope of Liability
Subject to our Accuracy Guarantee, you agree that CAW will not be liable for any loss or damage (whether direct, indirect, or arising under contract, tort, or breach of statutory duty) even if foreseeable, arising in connection with:
- The availability or inability to use the CAW platform or third-party submission portals.
- Use of or reliance on any content displayed on our platform.
- The loss of any manuscript or data uploaded to our platform (Creators are expected to maintain their own master backups).
- The outcome of any submission facilitated by CAW (including rejections or lack of response).
10.3 Aggregate Liability
CAW’s total aggregate liability to you for any claim arising under these terms shall be limited to the greater of:
- $500.00 USD; or
- The total fees paid by you the related service to CAW during the six (6) months immediately preceding the date of the claim. (Note: This ensures that even if a "double-refund" is triggered, your total payout is capped at a manageable number.)
10.4 Digital Risks & Data
Due to the inherent risks of the internet, CAW is not liable for any damage or viruses that may infect your devices. The uploading or downloading of any content is done at your own discretion and risk. You are solely responsible for any damage to your hardware or loss of data resulting from such activities.
10.5 Indemnity
You agree to indemnify and hold harmless Creative Artistic Works, L.L.C. against any claims, damages, or legal proceedings arising out of:
- Your use of the platform.
- Your submitted materials (including claims of copyright infringement by third parties).
- Your failure to comply with these Terms of Use.
10.6 No Partnership or Agency
You acknowledge that while CAW acts as a Proxy for the purpose of query submissions, these Terms do not create a partnership, joint venture, employment, or formal literary agency relationship between CAW and the Creator.
11. Beta Program Terms
11.1 Voluntary Participation and Termination
- Participation in the Creative Artistic Works, L.L.C., Beta Program is entirely voluntary and is not a contract for employment or representation.
- Either party—the participant or Creative Artistic Works, L.L.C.—may terminate participation in the program at any time, for any reason, with written notice.
11.2 Program Duration
- Unless otherwise negotiated in writing, participation in the Beta Program will automatically terminate one (1) year after the date of entrance.
11.3 Service Refinement and Evolution
- Beta participants will receive the best service currently available within the hub.
- Participants acknowledge that Creative Artistic Works, L.L.C., uses this program to actively refine administrative workflows, service deliverables, and pricing structures.
- As a result, specific service features and delivery methods may evolve during the participation period to better meet the goal of maximizing creator visibility.
11.4 Third-Party Agreements
- Professional Service Matching is provided solely as a referral infrastructure.
- Any resulting contracts, agreements, or service deliveries are strictly between the Creator and the independent service provider.
- These external professional relationships are not governed or covered by the Creative Artistic Works Beta Program Terms.
11.5 Feedback and Collaboration
- As a "Spark" stage partner, participants may be asked to provide honest feedback regarding clerical efficiency and the value of the administrative relief provided.
- All feedback provided during the program becomes the property of Creative Artistic Works, L.L.C., to be used for the improvement of the platform and future service offerings.
11.6 Continued Ownership
- Consistent with our core values, participants retain 100% ownership and creative control of their intellectual property throughout the duration of the beta period.
